a.What is Quality Complaints and Trade Disputes

Exporters need to project a good image of the country abroad to promote exports. Maintaining an enduring relationship with foreign buyers is of utmost importance, and complaints or trade disputes, whenever they arise, need to be settled amicably as soon as possible. Importers too may have grievances as well. In an endeavour to resolve such complaints or trade disputes and

to create confidence in the business environment of the country, a mechanism is being laid down to address such complaints and disputes in an amicable way.

b.Pre-Requisites for Filing Complaint / Trade Dispute in QCTD

Users can directly file a complaint in QCTD from provided link. Other pre-requisites as mentioned in the Chapter 8 of Foreign Trade Policy and Hand book of Procedures may be referred.

Foreign Complainant has to compulsorily register on the portal with valid email ID in order to file complaint against any Indian party.

c.Procedure for sending/ forwarding Court Order/ Summons

Services of judicial processes (summons, legal notices, orders, etc..) outside India are regulated by reciprocal arrangements between the Governments of India and Australia, finalized and notified by Ministry of Home Affairs (MHA) in criminal matters and Ministry of Law and Justice (MoLJ) in civil/commercial matters. Accordingly, any court or legal documents for service under the Australia-India Mutual Legal Assistance Treaty [MLAT] should be routed through the central authority in India i.e. Ministry of Home Affairs (Under Secretary, Ministry of Home Affairs, Internal Security-II Division/Legal Cell, 1st Floor, C Wing, NDCC_II Building, Jai Singh Road, New Delhi- 110001) in criminal matters and the Ministry of Law and Justice (MoLJ), (Department of Legal Affairs, 4th Floor, A-wing, Shastri Bhavan, New Delhi- 110001) in civil and commercial matters.
